Terms and Conditions for BRedPixel

Welcome to BRedPixel.

These Terms and Conditions (“Terms”) govern your access to and use of the BRedPixel Windows software, customer document upload portal, website, APIs, and related services (collectively, the “Service”).

By creating an account, purchasing a subscription, installing, accessing, or using BRedPixel, you agree to be legally bound by these Terms.

If you do not agree with these Terms, you must not use the Service.

1. About BRedPixel

BRedPixel is a Windows-based Software as a Service (SaaS) developed for professional service providers in India.

The Service is intended exclusively for authorized business users, including but not limited to:

  • e-Mitra Centres
  • CSC Centres
  • Cyber Cafés
  • Photo Studios
  • Online Service Centres
  • Other authorised service providers

BRedPixel is not intended for personal or consumer use.

2. Eligibility

To use BRedPixel, you must:

  • Be at least 18 years old; and
  • Be legally authorised to operate the business or act on behalf of the business using the Service.

You agree to provide accurate and complete registration information and keep it updated.

3. User Account

To use BRedPixel, you must create an account.

You may be required to provide:

  • Full Name
  • Business or Studio Name
  • Email Address
  • Mobile Number

You are responsible for:

  • Maintaining the confidentiality of your account credentials.
  • All activities performed using your account.
  • Preventing unauthorised access to your account.

4. One Account – One Computer

Each BRedPixel account is permanently linked to one Windows computer using its Hardware ID (including the motherboard serial number or an equivalent hardware identifier).

You agree that:

  • One account may only be used on one Windows computer.
  • Account sharing is prohibited.
  • Selling or transferring accounts is prohibited.
  • Hardware ID spoofing or modification is prohibited.
  • Attempting to bypass the licensing system is prohibited.
  • Device changes are permitted only with prior approval from BRedPixel in exceptional circumstances.

Violation of this policy may result in suspension or permanent termination of your account without refund.

5. Monthly Subscription

Access to premium features requires an active monthly subscription.

Your subscription includes access only for the registered device linked to your account.

Failure to renew your subscription may result in suspension or limitation of access until payment is successfully completed.

6. Payments

Subscription payments are securely processed through Cashfree Payments.

BRedPixel does not collect or store:

  • Credit Card Numbers
  • Debit Card Numbers
  • CVV
  • UPI PIN
  • Internet Banking Passwords
  • Banking Credentials

Payment processing is handled by Cashfree Payments according to its own Terms and Privacy Policy.

7. Subscription Refunds

Subscription fees are generally non-refundable after activation.

Refunds may be considered only in limited situations, including:

  • Duplicate payment.
  • Verified technical billing error.
  • Unauthorised payment confirmed after investigation.
  • Failure to activate a subscription due to a verified issue caused by BRedPixel.

Refund requests must be submitted within seven (7) calendar days of payment.

8. Customer Document Upload Service

BRedPixel provides a secure document upload system.

Customers may upload documents by scanning a QR code or opening a secure BRedPixel web page.

Uploaded documents are securely transmitted to Google Firebase and made available only to the assigned agent through the BRedPixel application for the requested service.

9. Temporary Document Storage

Customer-uploaded documents:

  • Are encrypted during transmission.
  • Are encrypted while stored.
  • Are stored temporarily in Google Firebase.
  • Are accessible only to the customer and the assigned agent or authorised staff.
  • Are automatically and permanently deleted within twenty-four (24) hours of upload.

BRedPixel does not permanently store uploaded customer documents.

10. Printing of Uploaded Documents

Uploaded documents are intended only for viewing and printing through the BRedPixel application.

The Software does not provide a feature to download or export uploaded customer documents.

After the document has been printed or after twenty-four (24) hours, whichever occurs first, the uploaded document is deleted from our cloud storage.

11. Local Files

BRedPixel does not access, scan, upload, or store photographs or documents located in the agent’s local folders, galleries, or storage devices.

Only files intentionally uploaded through the BRedPixel document upload portal are processed by our cloud services.

12. Customer Consent

Before retrieving, uploading, printing, verifying, or processing any customer document, the agent must obtain the customer’s consent or other lawful authorisation as required under applicable law.

The agent is solely responsible for ensuring that customer information is collected and processed lawfully.

13. Third-Party Integrations

BRedPixel may integrate with authorised third-party providers, including:

  • Google Firebase
  • Cashfree Payments
  • Sandbox
  • DigiLocker APIs
  • Other authorised verification providers

These providers operate under their own terms and privacy policies.

BRedPixel is not responsible for the availability, policies, or performance of third-party services.

14. Acceptable Use

You agree not to:

  • Share your account.
  • Share subscriptions.
  • Use one account on multiple computers.
  • Reverse engineer, decompile, or modify the Software.
  • Bypass licensing or security systems.
  • Spoof Hardware IDs.
  • Upload malicious software.
  • Retrieve or print customer documents without authorisation.
  • Use the Service for unlawful activities.

Violation of these Terms may result in immediate suspension or permanent termination.

15. Intellectual Property

All software, source code, designs, trademarks, logos, documentation, interfaces, graphics, APIs, and related intellectual property remain the exclusive property of BRedPixel.

No ownership rights are transferred to users.

16. Software Updates

BRedPixel may release updates, bug fixes, security patches, improvements, or new features at any time.

Certain updates may be mandatory for continued use of the Service.

17. Government Disclaimer

BRedPixel is an independent software platform.

BRedPixel is not affiliated with, endorsed by, authorised by, sponsored by, or operated by:

  • Government of India
  • Any State Government
  • DigiLocker
  • UIDAI
  • Passport Seva
  • CSC
  • MP Online
  • Income Tax Department
  • Election Commission of India
  • Any Ministry or Government Department

References to government services are provided solely for user convenience.

18. Disclaimer of Warranties

The Service is provided on an “AS IS” and “AS AVAILABLE” basis.

To the fullest extent permitted by applicable law, BRedPixel disclaims all express and implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee uninterrupted, error-free, or defect-free operation.

19. Limitation of Liability

To the fullest extent permitted by applicable law:

BRedPixel shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, business interruption, loss of goodwill, or loss of data arising from the use of or inability to use the Service.

BRedPixel is not responsible for:

  • Unauthorised use of customer documents by agents.
  • Incorrect information supplied by users.
  • Rejection of documents or photographs by any authority.
  • Third-party API failures.
  • Internet failures.
  • Hardware failures.
  • Power outages.
  • Delays caused by government portals.

Our total liability for any claim shall not exceed the subscription fees paid by you during the twelve (12) months immediately preceding the event giving rise to the claim.

Nothing in these Terms excludes liability where such exclusion is prohibited by applicable law.

20. Indemnification

You agree to indemnify and hold harmless BRedPixel, its developers, employees, affiliates, and representatives from any claims, liabilities, damages, penalties, costs, or legal expenses arising from:

  • Your misuse of the Service.
  • Unauthorised processing of customer information.
  • Violation of these Terms.
  • Violation of applicable laws.
  • Infringement of third-party rights.

21. Suspension and Termination

BRedPixel may suspend or terminate your account without prior notice if you:

  • Violate these Terms.
  • Commit payment fraud or chargebacks.
  • Share accounts.
  • Circumvent licensing.
  • Provide false information.
  • Engage in unlawful activity.
  • Misuse customer information.

Termination immediately ends your right to use the Service.

22. Privacy

Your use of BRedPixel is also governed by our Privacy Policy, which forms part of these Terms.

23. Governing Law

These Terms shall be governed by the laws of India.

Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts in India.

24. Changes to These Terms

BRedPixel may modify these Terms at any time.

Updated Terms become effective upon publication unless otherwise stated.

Your continued use of the Service after the updated Terms become effective constitutes acceptance of the revised Terms.
