Welcome to BRedPixel

These Terms and Conditions (“Terms”) govern your access to and use of the BRedPixel Windows software, website, and related services (“Service”). By creating an account, purchasing a subscription, installing, or using BRedPixel, you agree to be bound by these Terms.

If you do not agree with these Terms, you must not use the Service.

1. About BRedPixel

BRedPixel is a Windows-based Software as a Service (SaaS) developed and operated by the BRedPixel team. The software is currently intended for use only within India.

2. Eligibility

You must be at least 18 years old or have the permission of a parent or legal guardian to use our Service.

You agree to provide accurate and complete information during registration and keep your account information updated.

3. User Account

To access the Service, you may be required to create an account.

You agree to provide accurate information including:

  • Full Name
  • Studio Name
  • Email Address
  • Mobile Number
  • Any other information reasonably required to provide the Service.

You are solely responsible for maintaining the confidentiality of your account credentials.

4. Software License

BRedPixel grants you a limited, non-exclusive, non-transferable, and revocable license to use the Software in accordance with these Terms.

A subscription does not transfer ownership of the Software.

5. One Subscription – One Computer

Each subscription is permanently linked to one Windows computer using its Hardware ID (including the Motherboard Serial Number or an equivalent hardware identifier).

  • One subscription may only be used on one computer.
  • License sharing is strictly prohibited.
  • Selling or transferring licenses is prohibited.
  • Changing the registered computer is not supported unless approved by BRedPixel in exceptional circumstances at our sole discretion.
  • Any attempt to modify, spoof, bypass, or manipulate the Hardware ID or licensing system is strictly prohibited.

Violation of this policy may result in immediate suspension or permanent termination of the subscription without refund.

6. Payments

Payments are securely processed through Cashfree Payments.

BRedPixel does not collect or store:

  • Debit Card Numbers
  • Credit Card Numbers
  • UPI PIN
  • CVV
  • Net Banking Passwords
  • Banking Credentials

Payment processing is handled by Cashfree according to their own Terms and Privacy Policy.

7. Subscription

Subscription fees must be paid before accessing premium features.

Failure to complete payment may result in suspension or limitation of Service access.

8. Refund Policy

Subscription payments are generally non-refundable.

Refunds may only be considered in limited situations, including:

  • Duplicate payment.
  • Incorrect billing due to technical error.
  • Unauthorized payment verified by BRedPixel.
  • Other exceptional circumstances at our sole discretion.

Refund approval is entirely at the discretion of BRedPixel unless otherwise required by applicable law.

9. Data Collection

To operate the Service, BRedPixel may collect:

  • Name
  • Studio Name
  • Email Address
  • Mobile Number
  • Hardware ID (Motherboard Serial Number or equivalent identifier)
  • Firebase Authentication ID
  • IP Address
  • Device Information
  • Subscription Status
  • Software Version
  • Print Count
  • Diagnostic Information
  • Security Logs

This information is used solely for operating the Service, verifying licenses, preventing fraud, improving security, customer support, and software improvements.

10. Photo Processing

BRedPixel is designed to assist users in printing photographs.

We do not permanently store, upload, or claim ownership of the photographs you print through the Software.

The Software may record only the total number of prints processed for subscription management, usage statistics, fraud prevention, and software improvement.

Users remain solely responsible for the legality, ownership, copyright, and content of the photographs they print.

11. Third-Party Services

Our Service relies on trusted third-party providers including:

  • Google Firebase
  • Cashfree Payments

Your use of these third-party services is subject to their own Terms and Privacy Policies.

BRedPixel is not responsible for the availability, security, or performance of third-party services.

12. Acceptable Use

You agree not to:

  • Share your account with others.
  • Share or resell your subscription.
  • Reverse engineer, decompile, or modify the Software.
  • Bypass the licensing system.
  • Spoof or alter Hardware IDs.
  • Use pirated versions of the Software.
  • Upload malicious software.
  • Attempt unauthorized access to our servers.
  • Use the Software for illegal activities.

Violation of these Terms may result in immediate account suspension or permanent termination.

13. Intellectual Property

All software, source code, trademarks, branding, logos, designs, documentation, graphics, and other intellectual property associated with BRedPixel remain the exclusive property of BRedPixel.

No ownership rights are transferred to users.

14. Software Updates

We may release updates, improvements, bug fixes, security patches, and new features at any time.

Some updates may be mandatory to continue using the Service.

15. Service Availability

While we strive to provide reliable service, we do not guarantee uninterrupted availability.

The Service may be temporarily unavailable due to:

  • Maintenance
  • Internet outages
  • Firebase downtime
  • Cashfree service interruptions
  • Windows system issues
  • Power failures
  • Circumstances beyond our reasonable control

16. Government Portal Disclaimer

BRedPixel is an independent software solution that assists users with printing and related workflow.

BRedPixel is not affiliated with, endorsed by, authorized by, or operated by any Government department, Ministry, CSC, MP Online, or other Government authority.

Users are solely responsible for complying with all applicable government rules and regulations while using third-party portals.

17. Disclaimer of Warranties

The Service is provided on an “AS IS” and “AS AVAILABLE” basis.

To the fullest extent permitted by law, BRedPixel disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Software will always operate without interruption, error, or defects.

18. Limitation of Liability

To the fullest extent permitted by law:

  • BRedPixel shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages.
  • BRedPixel shall not be responsible for loss of profits, business interruption, loss of data, loss of goodwill, or any damages arising from the use or inability to use the Software.
  • Our total liability for any claim shall not exceed the total subscription fees paid by you to BRedPixel during the twelve (12) months immediately preceding the event giving rise to the claim.

Nothing in these Terms excludes liability where such exclusion is prohibited by applicable law.

19. Indemnification

You agree to indemnify and hold harmless BRedPixel, its developers, operators, affiliates, and representatives from any claims, damages, liabilities, losses, costs, or legal expenses arising from:

  • Your misuse of the Software.
  • Violation of these Terms.
  • Violation of applicable laws.
  • Infringement of third-party rights.

20. Suspension and Termination

We reserve the right to suspend or permanently terminate your account without prior notice if you:

  • Violate these Terms.
  • Engage in piracy.
  • Share subscriptions.
  • Circumvent licensing.
  • Commit payment fraud or chargebacks.
  • Provide false information.
  • Engage in unlawful or abusive conduct.

Termination immediately ends your right to use the Software.

21. Privacy

Your use of BRedPixel is also governed by our Privacy Policy, which explains how your personal information is collected, used, and protected.

22. Governing Law

These Terms shall be governed by the laws of India.

Any disputes arising from these Terms or the use of the Service shall be subject to the exclusive jurisdiction of the competent courts in India.

23. Changes to These Terms

We may update these Terms from time to time.

Updated Terms become effective immediately upon publication unless otherwise stated.

Your continued use of the Service after any update constitutes acceptance of the revised Terms.
